#Yardley Bond Street Original Male and Yardley Bond Street 33 Female Digital Competition

  1. This Yardley Bond Street Original Male and Yardley Bond Street 33 Female Digital Competition (“Competition”) is organised and conducted by Indigo Brands (Pty) Ltd, a subsidiary of AVI Limited, including their affiliates, partners, associations and agents (“Promoter”).
  1. This Competition will run from 14 October 2016 to 7 November 2016. Entries received after the closing date will not be considered.

WHO CAN ENTER?

  1. Participants must be 13 (thirteen) years or older (if under 18 (eighteen) years old, you must be duly assisted by your legal guardian) and have a valid identity document or passport and reside in the Republic of South Africa during the period of the Competition, up to and including the dates of determination of the winners and prize redemption dates (“Participants”/”you”/”your”).
  1. Participants may not enter or receive a prize if they are directors, members, partners, employees, agents of or consultants of the Promoter, their subsidiaries, holding companies, divisions and/or associated companies or of the advertising or promotion agencies or any other person who directly or indirectly controls or is controlled by the Promoter, or their spouses, life partners, immediate family members or business partners.
  1. The Competition is not open for entry by or on behalf of a legal entity and Participants cannot use the account of a legal entity to enter the Competition. Entries must be submitted by the Participant themselves and not by a third party on the Participant’s behalf.
  1. By entering this Competition, all Participants agree to be bound by these terms and conditions, which will be interpreted by the Promoter and the Promoter’s decision regarding any issue with the Competition will be final and binding and no correspondence will be entered into.

HOW TO ENTER

  1. Entry into the Competition will be via the Competition link promoted on Instagram (@YardleyLondon_SA) and Facebook (Yardley London SA) by the Promoter which will divert you to the Competition

Step 2: Answer the multiple choice questions correctly

Step 3: Compete your details on the entry form and submit your entry

  1. Entries are unlimited but each entry of a Participant must have the correct answers. Winners may only receive 1 (one) Prize.
  1. Incomplete or incorrect entries will not be eligible.
  1. Participants are responsible for their own costs of connecting to Instagram, Facebook and the internet. No responsibility is accepted for any entry that is not delivered, received or is delayed or damaged due to technical reasons or failure on the part of your service provider. Proof of sending is not proof of receipt.

PRIZES

  1. You stand to win the grand prize of a shopping spree for you and a partner valued at R30 000 (thirty thousand rand) at a shopping mall in the Republic of South Africa of your choice (subject to the availability of the Promoter securing the shopping vouchers at the selected shopping mall).
  1. There are also 4 (four) runner up Yardley Bond Street hamper prizes for the second, third, fourth and fifth place winners. Each hamper consists of 1 (one) x Bond Street Original Male fragrance and 1 (one) x Bond Street 33 Female fragrance in a Yardley gift bag.
  1. The grand prize winners will be subject to the terms and conditions of the shopping vouchers.
  1. Prizes are non-transferable and may not be redeemed or exchanged for cash.
  1. The prizes may differ from that shown on the promotional material with regard to illustrations, images, colour and specifications and same shall be subject to availability and in the Promoter’s sole discretion to select same.
  1. The Promoter reserves the right to substitute the prizes for an alternative prize of equal or greater value should the prize promoted not be available for any reason.
  1. The prizes do not cover any other costs of the winner.

DETERMINATION OF WINNERS

  1. The winners will be determined by a random draw. The judge’s decision is final and no correspondence will be entered into. All winners will be determined in the sole discretion of the Promoter.
  1. The winners will be contacted via telephone on the number provided in the entry form. Winners will be contacted as soon as reasonably possible after the determination of the prize winners taking place. The winners will have to answer Consumer Protection Act related questions and provide their full names and identity numbers.
  1. The Promoter will make 2 (two) attempts to contact and notify the selected winner. If the selected winner cannot be contacted personally by the Promoter within 48 (forty-eight) hours, or if after first being contacted by the Promoter, is not reachable, or the winner fails to provide the Promoter with the required information to hand over the prize, the winner will forfeit the prize and a replacement winner will be selected from remaining qualifying Participants. This process shall continue until the winner has been contacted in terms of the terms and conditions.
  1. The Promoter reserves the right to select an alternative winner in the event that they reasonably believe, in their sole discretion, that the winner is not eligible to win, has contravened any of these terms and conditions, acted fraudulently with regards to the Competition, has acted in a manner that is not in the spirit of the Competition, their conduct can be reasonably interpreted as scamming or circumventing the rules of the Competition, acted fraudulently with regards to the Competition, if it would be unlawful to award the prize or if the winner fails to accept the prize after 2 (two) attempts, or fails to co-operate with the Promoter, its agents or the designer for any reason whatsoever, if after first being contacted by the Promoter, is not reachable, or the winner fails to provide the Promoter with the required information to hand over the prize. In any of these instances the winner will be disqualified and forfeit the prize. The Promoter’s decision shall be final and no correspondence will be entered into.
  1. Prize winners will be required to sign an acknowledgement of receipt of their prize, if applicable, and will be required to furnish the Promoter with their names and identity numbers in terms of the Consumer Protection Act.

CONSENT TO ENTRY AND PHOTOGRAPHS INCLUDING RIGHTS THERETO

  1. Winners have the right to decline permission to use your name or image in marketing material or participate in any marketing activity. The Promoter reserves the right to request the grand prize winner to have photographs taken of them while on the shopping spree. Should the grand prize winner agree thereto, any photos subsequently taken will become the property of the Promoter, may be used by the Promoter and this will be without any compensation to the grand prize winner or any third party. These terms and conditions shall apply to the rights to the photos.
  1. Should the photos taken not be the property of the Promoter for any reason whatsoever, the Participant hereby grants to the Promoter the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sub-licensable right and license to use, perform, exhibit, reproduce and/or otherwise exploit the Instagram or Facebook entry and any photos taken with the grand prize winner’s consent, in any manner and in any and all distribution channels, venues or media now known or hereafter devised, without further notice or any compensation to Participant. Participant further agrees, upon the Promoter’s request and without compensation, to sign any and all necessary and appropriate documents so as to effect, perfect or record such grant of license rights.

PUBLICITY AND DATA PRIVACY

  1. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoter and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
  1. All personal information relating to the Participants will be used solely in accordance with South African consumer and data protection legislation.
  1. Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoter in terms of the Consumer Protection Act.

GENERAL

  • Please note that the following terms require you to take on risk, limit the liability of the Promoter and indemnify the Promoter. Please read them carefully and contact the Promoter if you have any questions!
  1. The Promoter reserves the right to extend, reasonably shorten, suspend the time period of the Competition or terminate the Competition whenever it should so choose for technical, commercial, or operational reasons, or for reasons beyond its control or generally for any reason whatsoever within their sole discretion. The Competition, its prizes, and terms and conditions may be amended by the Promoter, at any time during the Competition, and will be applied and interpreted within their sole discretion. In such an event, all Participants waive any rights that they may have/purport to have in terms of this Competition, and acknowledge that they will have no recourse against the Promoter whatsoever.
  1. All publicity and other materials will be the sole property of the Promoter.
  1. Participants confirm by their entry into the Competition that Instagram and Facebook are not the promoters of this Competition, it is in no way sponsored, endorsed or administered by or associated with Instagram or Facebook and they fully release Instagram and Facebook from any liability in connection with this Competition. Any questions, comments or complaints regarding the Competition are to be directed to the Promoter.
  1. The Promoter is not responsible for – 
  • entries that are lost, late, illegible/garbled, corrupted, misdirected, defective, inaccessible, compromised, incomplete, damaged or delayed and all such entries are void and will not result in Competition entry;
  • any entry that is not delivered, received or is delayed or damaged due to technical reasons or failure on the part of your service provider. Proof of sending is not proof of receipt. Participants are responsible for their own costs of connecting to the Instagram or Facebook account.
  1. To the fullest extent permitted by law, by participating, the Participant indemnifies, releases and agrees to hold harmless the Promoter, their associated, holding and subsidiary companies, and its directors, officers, agents, representatives, shareholders, employees, successors and assigns from any and all claims or liability arising from participating in the Competition, any Competition-related activity and/or acceptance, receipt, possession or use/misuse of any prize. 
  1. To the extent permitted by law, the Promoter will not be liable in any way whatsoever, for any claims arising from loss, injury, damage or costs, suffered by a Participant in relation to this Competition or the prizes offered, including but not limited to claims relating to defects in the prizes or any losses caused by such defects or losses arising from incorrect or inaccurate information supplied by Participants.
  1. The Promoter will not be liable for any loss suffered as a result of incomplete or incorrect information provided.
  1. South African law shall govern these competition terms and conditions and the courts of South Africa shall have exclusive jurisdiction.

#YardleyGorgeousDress Instagram Competition

  1. This #YardleyGorgeousDress Competition (“Competition”) is organised and conducted by Indigo Brands (Pty) Ltd, a subsidiary of AVI Limited, including their affiliates, partners, associations and agents (“Promoter”).
  1. This Competition will run from 12th August to 12th of September. Entries received after the closing date will not be considered.

WHO CAN ENTER?

  1. Participants must be 13 years or older (if under 18 years old, you must be duly assisted by your legal guardian) and have a valid identity document or passport and reside in the Republic of South Africa during the period of the Competition, up to and including the dates of determination of the winners and prize redemption dates (“Participants”/”you”/”your”).

HOW TO ENTER

  1. Entry into the Competition will be via the Competition link posted on Instagram (@YardleyLondon_SA) and Facebook (Yardley London SA) by the Promoter which will take you to the Competition Participants are required to have their own personal Instagram account or Facebook account to enter this Competition.

Step 2: Design your dream dress using the options available in the Competition microsite

Step 3: Save the image of your dream dress and either share the image on your Instagram account and make sure you tag @YardleyLondon_SA and use the hashtag #YardleyGorgeousDress OR upload it to the Yardley London SA Facebook page and use the hashtag #YardleyGorgeousDress

  1. Entries are unlimited but each entry of a Participant must be unique. Winners may only receive 1 (one) Prize.
  1. The Participant whose entry gets the most “likes” on Instagram or on Facebook will be the grand prize winner. There are also 3 (three) runner up Yardley London Gorgeous hamper prizes for the second, third and fourth place.
  1. Instagram and Facebook prohibits the creation of an account for anyone other than yourself. All Participants agree not to create or utilise multiple accounts for yourself for the purposes of this Competition. You also represent that all information you provide or provided to Instagram and Facebook upon registration and at all other times will be true, accurate, current and complete and you agree to update your information as necessary to maintain its truth and accuracy. Therefore all Participants and voters should respect this rule when participating in the Competition.

  1. Participants are responsible for their own costs of connecting to Instagram, Facebook and the internet. PRIZES

  1. You stand to win the grand prize of a dream dress custom made for you by designer Joel Janse van Vuuren in the design chosen by you and submitted as your winning entry. The grand prize includes a consultation lunch with the designer, Joel Janse van Vuuren, as well as 2 (two) dress fittings. All design costs (including the consultation and the 2 (two) dress fittings) and fabric will be covered by the Promoter as per the agreement with the designer.
  1. There are also 3 (three) runner up Yardley London Gorgeous hamper prizes for the second, third and fourth place winners, consisting of 1 x Gorgeous in Bloom 30ml EDP and 1 x Gorgeous in Cashmere 30ml EDP.
  1. The grand prize winner will be contacted to arrange consultation lunch with the designer as well as 2 (two) dress fittings. The designer will provide the grand prize winner with a choice of 3 (three) different gold coloured or gold variation coloured fabrics approved by the Promoter. The design of the dress will be as per the winning entry unless agreed otherwise with the Promoter.
  1. The Promoter will have the final say as to when the dress has been finished and the grand prize winner will have no further claim against the Promoter or the designer once the dress has been delivered to the grand prize winner. The date of delivery of the finished dress will be 15 December 2016 or as soon as reasonably possible thereafter. The grand prize winner will make all reasonable attempts to ensure they are available for the consultation lunch and the 2 (two) dress fittings as arranged, in order to allow for the designer to finish the dress on time.
  1. Prizes are non-transferable and may not be redeemed or exchanged for cash.
  1. The prizes may differ from that shown on the promotional material with regard to illustrations, images, colour and specifications and same shall be subject to availability and in the Promoter’s sole discretion to select same.
  1. The Promoter reserves the right to substitute the prizes for an alternative prize of equal or greater value should the prize promoted not be available for any reason.
  1. If necessary, the Promoter will, at its sole discretion, arrange for the grand prize winner to be transported to and from the consultation lunch and the dress fittings. All transportation will be for the same day of the consultation lunch or the dress fittings. Overnight stays will not be permitted or covered. The prizes do not cover any other costs of the winner.

DETERMINATION OF WINNERS

  1. The Participant whose Instagram or Facebook entry gets the most “likes” will be the grand prize winner. There are also 3 (three) runner up Yardley London Gorgeous hamper prizes for the second, third and fourth place. If there is a tie or Participants with an equal amount of the highest number of “likes”, the winner will be determined by a random draw consisting of these tied entries. The judge’s decision is final and no correspondence will be entered into. All winners will be determined in the sole discretion of the Promoter.
  1. The winners will be contacted via direct message from the Promoter to their Instagram or Facebook account. Winners will be contacted as soon as reasonably possible after the determination of the prize winners taking place. Participants are advised to monitor their Instagram or Facebook account for any such notifications.
  1. The Promoter will make 1 (one) attempt to contact and notify the selected winner. If the selected winner does not respond to the notification by contacting the Promoter within 48 (forty-eight) hours, or if after first being contacted by the Promoter, is not reachable, or the winner fails to provide the Promoter with the required information to hand over the prize, the winner will forfeit the prize and a replacement winner will be selected from remaining qualifying Participants. This process shall continue until the winner has been contacted in terms of the terms and conditions.
  1. Participants must ensure that the settings on their Instagram or Facebook account allow for them to participate in the Competition and for the Promoter to see their comments and entries on the YardleyLondonSA Instagram account or Yardley London SA Facebook page. The Promoter will not be liable for any “hidden” comments or entries.
  1. The Promoter reserves the right to select an alternative winner in the event that they reasonably believe, in their sole discretion, that the winner is not eligible to win, has contravened any of these terms and conditions and/or the Instagram Terms or Facebook Terms, has created multiple Instagram or Facebook accounts in order to enter more than permitted or get more “likes”, acted fraudulently with regards to the Competition, has acted in a manner that is not in the spirit of the Competition, their conduct can be reasonably interpreted as scamming or circumventing the rules of the Competition, acted fraudulently with regards to the Competition, if it would be unlawful to award the prize or if the winner fails to accept the prize after 2 (two) attempts, or fails to co-operate with the Promoter, its agents or the designer for any reason whatsoever, if after first being contacted by the Promoter, is not reachable, or the winner fails to provide the Promoter with the required information to hand over the prize. RESTRICTIONS ON CONTENT OF COMMENTS ON ENTRIES

  1. The Promoter reserves the right to remove any comments and content uploaded should this be deemed unsuitable by the Promoter.  All content is published at the discretion of the Promoter.
  1. Any comment or other material uploaded by users do not necessarily reflect the Promoter’s views or ideals. The Promoter does not warrant the accuracy of any statement made by Participants.
  1. Comments that are uploaded must be original.
  1. Participants participate at their own risk and take responsibility for all comments under their Instagram account or Facebook account and information provided.
  1. The comment cannot violate the copyright or other rights of any third party.
  1. The comment cannot include inappropriate, offensive, illegal or obscene material or gestures (e.g., hate speech or pornographic images).
  1. The comment cannot disparage, reflect poorly upon or otherwise adversely affect the goodwill and/or reputation of the Promoter.
  1. The comment must be relevant to the theme of the Competition.
  1. Any comment determined by the Promoter in their sole discretion to be in violation of the preceding criteria will not be published or removed immediately, will be void and will not result in Competition entry.

CONSENT TO ENTRY AND PHOTOGRAPHS INCLUDING RIGHTS THERETO

  1. Participation in the Competition will require for example that your name and Instagram handle or Facebook profile be displayed on the YardleyLondonSA Instagram account or on the Yardley London SA Facebook page. SHOULD YOU NOT AGREE THERETO, DO NOT ATTEMPT TO ENTER THE COMPETITION.
  1. Winners have the right to decline permission to use your name or image in marketing material or participate in any marketing activity. The Promoter reserves the right to request the grand prize winner to have photographs taken of them in the dress. Should the grand prize winner agree thereto, this consent must be in writing. Any photos subsequently taken will become the property of the Promoter, may be used by the Promoter and this will be without any compensation to the grand prize winner or any third party. These terms and conditions shall apply to the rights to the photos.
  1. Should the Instagram or Facebook entry and any photos taken not be the property of the Promoter for any reason whatsoever, the Participant hereby grants to the Promoter the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sub-licensable right and license to use, perform, exhibit, reproduce and/or otherwise exploit the Instagram or Facebook entry and any photos taken with the grand prize winner’s consent, in any manner and in any and all distribution channels, venues or media now known or hereafter devised, without further notice or any compensation to Participant.   1. This Yardley #EnglishBlazerRed Competition (“Competition”) is organised and conducted by Indigo Brands (Pty) Ltd, a subsidiary of AVI Limited, including their affiliates, partners, associations and agents (“Promoter”).
  1. This Competition will run from 17 August 2016 to 12 September 2016. Weekly draws will be done for the hamper prizes. Closing times for entries for the weekly hamper prizes will be on the Friday at noon (26 August, 2 September and 9 September 2016 or as advised otherwise). Entries received after the closing date of the Competition will not be considered.

  1. Step 1: Take a picture of yourself or get a friend to take a picture of you showing your style with a touch of red

Step 2: Post your picture on Instagram using the hashtag #EnglishBlazerRed OR upload it to the English Blazer SA Facebook page and use the hashtag #EnglishBlazerRed

  1. Remember that it must be your own original picture and you or your stylish outfit or accessories must be in the picture with a touch of red, and you must use the hashtag #EnglishBlazerRed to qualify.
  1. All relevant and valid entries will go into a draw to stand a chance to win an outfit makeover to the value of R10 000 (ten thousand rand) and to attend an exclusive event with 1 (one) of the influencers or an English Blazer hamper.
  1. Entries are limited to 1 (one) entry per person. The first entry received from a Participant will be the valid entry. Winners may only receive 1 (one) prize.

PRIZES

DETERMINATION OF WINNERS

  1. The draws for the hamper prizes Competition will take place weekly. Entries for the weekly draws will close on Fridays at noon (26 August, 2 September and 9 September 2016 or as advised otherwise) and draws will be conducted the following week. The draw for the main prize winner will take place as soon as reasonably possible after the closing date of the Competition. All winners will be determined by a random draw.
  1. The winners will be contacted via direct message from the Promoter to their Instagram or Facebook account. Winners will be contacted as soon as reasonably possible after the determination of the prize winners taking place. Participants are advised to monitor their Instagram or Facebook account for any such notifications.
  1. The Promoter will make 1 (one) attempt to contact and notify the selected winner. If the selected winner does not respond to the direct message by contacting the Promoter within 24 (twenty-four) hours, or if after first being contacted by the Promoter, is not reachable, or the winner fails to provide the Promoter with the required information to hand over the prize, the winner will forfeit the prize and a replacement winner will be selected from remaining qualifying Participants. This process shall continue until the winner has been contacted in terms of the terms and conditions.

  1. The image cannot disparage, reflect poorly upon or otherwise adversely affect the goodwill and/or reputation of the Promoter.
  1. The image must be relevant to the theme of the Competition.
  1. Any image determined by the Promoter in their sole discretion to be in violation of the preceding criteria will not be published or removed immediately, will be void and will not result in Competition entry.

GRANTING OF RIGHTS IN IMAGE

  1. Participation in the Competition will require for example that your name, Instagram or Facebook account and photo be displayed on Instagram or Facebook. SHOULD YOU NOT AGREE THERETO, DO NOT ATTEMPT TO ENTER THE COMPETITION. Winners have the right to decline permission to use their name or image in marketing material or participate in any marketing activity, however due to the public nature of this Competition, should you decide to do so, you will not be able to participate in the Competition.

  1. Participants with unique code queries may be required to send proof of the unique code printed on the pack (for example send a photo of the unique code on the pack) in order for the Promoter to be able to assist and resolve the query.
  1. All publicity and other materials will be the sole property of the Promoter.

To the fullest extent permitted by law, by participating, the Participant indemnifies, releases and agrees to hold harmless the Promoter, their associated, holding and subsidiary companies, and its directors, officers, agents, representatives, shareholders, employees, successors and assigns from any and all claims or liability arising from participating in the Competition, any Competition-related activity and/or acceptance, receipt, possession or use/misuse of any prize.

To the extent permitted by law, the Promoter will not be liable in any way whatsoever, for any claims arising from loss, injury, damage or costs, suffered by a Participant in relation to this Competition or the prizes offered, including but not limited to claims relating to defects in the prizes or any losses caused by such defects or losses arising from incorrect or inaccurate information supplied by Participants.
  1. The Promoter will not be liable for any loss suffered as a result of incomplete or incorrect information provided.
  1. South African law shall govern these competition terms and conditions and the courts of South Africa shall have exclusive jurisdiction.
