Yardley London South Africa Intense Rouge Lipstick Facebook Competition

  1. This Yardley London South Africa Intense Rouge Lipstick Facebook Competition (“Competition”) is organised and conducted by Indigo Brands (Pty) Ltd, a subsidiary of AVI Limited, including their affiliates, partners, associations and agents (“Promoter”).
  2. This Competition will run weekly from 24 September 2018 and close at 08h00 on 5 October 2018. Entries received after the closing date and time will not be considered.

    WHO CAN ENTER?

  3. Participants must be 13 (thirteen) years or older (if under 18 (eighteen) years old, they must be given consent by their legal guardian) and have a valid identity document or passport and reside in the Republic of South Africa during the period of the Competition, up to and including the dates of determination of the winners and prize redemption dates (“Participants”/”you”/”your”).
  4. Participants may not enter or receive a prize if they are directors, members, partners, employees, agents of or consultants of the Promoter, their subsidiaries, holding companies, divisions and/or associated companies or of the advertising or promotion agencies or any other person who directly or indirectly controls or is controlled by the Promoter, or their spouses, life partners, immediate family members or business partners.
  5. The Competition is not open for entry by or on behalf of a legal entity and Participants cannot use the account of a legal entity to enter the Competition. Entries must be submitted by the Participant themselves and not by a third party on the Participant’s behalf.
  6. By entering this Competition, all Participants agree to be bound by these terms and conditions, which will be interpreted by the Promoter and the Promoter’s decision regarding any issue with the Competition will be final and binding and no correspondence will be entered into.

    HOW TO ENTER

  7. Entry into the competition will be via the Yardley London SA Facebook page.

  8. Step 1: Show us your “Intense Look” by uploading a photo on the Yardley London SA Facebook page
  9. Step 2: Include the hashtag #IntenseRouge with your post in the caption
  10. Entries will only be valid if both steps are completed for the entry.
  11. Entries are unlimited but each entry must be unique (not a duplicate) and relevant to the theme to go into the draw. The “Intense Look” should signify your intense rouge/red lipstick look.
  12. Winners will be determined by a random draw. Judges decisions are final and no correspondence will be entered into.
  13. Participants are required to have their own personal Facebook account.
  14. Incomplete or incorrect entries will not be eligible to be considered or entered into the draw.
  15. Participants are responsible for their own costs of connecting to Facebook and the internet. No responsibility is accepted for any entry that is not delivered, received or is delayed or damaged due to technical reasons or failure on the part of your service provider. Proof of sending is not proof of receipt.

    PRIZES
  16. You stand a chance to win 1 (one) of 20 (twenty) Yardley hampers each consisting of 1 (one) Yardley Intense Rouge Lipstick (R89.95), 1 (one) Yardley Intense Matte Lipstick (R109.95), 1 (one) Yardley Intense Lash Mascara (R151.95), 1 (one) Yardley Eye Shadow Quad (R130.95) and 1 (one) Yardley Stayfast Eye Shadow Stick (R120.95).
  17. The prize is non-transferable and is not redeemable for cash.
  18. The prize may differ from that shown on the promotional material with regard to illustrations, images, colour and specifications and same shall be subject to availability and in the Promoter’s sole discretion to select same.
  19. The Promoter reserves the right to substitute the prizes for an alternative prize of equal or greater value should the prize promoted not be available for any reason.
  20. The prize does not cover any other costs of the winner whatsoever.

    DETERMINATION OF WINNERS
  21. The winners will be determined by a random draw as soon as reasonably possible after the close of the Competition.
  22. The potential winners will be contacted via direct message from the Promoter to their Facebook account as soon as reasonably possible after the determination of the prize winners taking place. Participants are advised to monitor their Facebook account for any such notifications and ensure that their settings allow them to receive direct messages from the Promoter, if not, the prize may be forfeited.
  23. The Promoter will make 1 (one) attempt to contact and notify the selected potential winner and request that they send the Promoter their contact details within 48 (forty-eight) hours of the direct message being sent. If the selected potential winner does not respond to the notification within 48 (forty-eight) hours, or cannot be contacted via direct message, or if after first being contacted by the Promoter, is not reachable, or the potential winner fails to provide the Promoter with the required information to hand over the prize, the potential winner will forfeit the prize and a replacement winner will be selected from remaining qualifying Participants. This process shall continue until the winner has been contacted in terms of the terms and conditions.
  24. Participants must ensure that privacy settings on their Facebook account allow for them to participate in the Competition, for the Promoter to see their comments and entries on the Yardley London SA Facebook page and for them to receive direct messages from the Promoter. The Promoter will not be liable for any “hidden” comments or entries. Only entries that are visible to the Promoter at the cut-off time will be considered.
  25. Once the Promoter has received the contact details from the potential winner, he/she will be required to furnish the Promoter with their full name, identity number and answer questions as required in terms of the Consumer Protection Act.
  26. The Promoter will make arrangements with the winner regarding delivery of the prize.
  27. Once the winners have been determined there will be an announcement on the Yardley London SA Facebook page. In line with data protection legislation, the names of winners will only be announced should they have consented to having their names disclosed.
  28. The Promoter reserves the right to select an alternative winner in the event that they reasonably believe, in their sole discretion, that the winner is not eligible to win, the post is not relevant to the criteria set out above, has contravened any of these terms and conditions and/or the Facebook Terms, has created multiple Facebook accounts in order to enter more than permitted, acted fraudulently with regards to the Competition, has acted in a manner that is not in the spirit of the Competition, their conduct can be reasonably interpreted as scamming or circumventing the rules of the Competition, acted fraudulently with regards to the Competition if it would be unlawful to award the prize or if the winner fails to accept the prize after 2 (two) attempts for any reason whatsoever, if after first being contacted by the Promoter, is not reachable, or the winner fails to provide the Promoter with the required information to hand over the prize. In this instance the winner will be disqualified and forfeit the prize. The Promoter’s decision shall be final and no correspondence will be entered into.

    RESTRICTIONS ON CONTENT OF
    COMMENT AND PHOTO
  29. The Promoter reserves the right to remove any comments, photos and content uploaded should this be deemed unsuitable by the Promoter.  All content is published at the discretion of the Promoter.
  30. Any comment, photo or other material uploaded by users do not necessarily reflect the Promoter’s views or ideals. The Promoter does not warrant the accuracy of any statement made by Participants.
  31. Comments and photos that are uploaded must be original.
  32. Participants participate at their own risk and take responsibility for all comments and photos under their Facebook account and information provided.
  33. The comment or photo cannot violate the copyright or other rights of any third party.
  34. The comment or photo cannot include inappropriate, offensive, illegal or obscene material or gestures (e.g., hate speech or pornographic images).
  35. The comment or photo cannot disparage, reflect poorly upon or otherwise adversely affect the goodwill and/or reputation of the Promoter.
  36. The comment and photo must be relevant to the theme of the Competition.
  37. Any comment or photo determined by the Promoter in their sole discretion to be in violation of the preceding criteria will not be published or removed immediately, will be void and will not result in Competition entry.

    GRANTING OF RIGHTS IN COMMENT AND PHOTO
  38. Participation in the Competition will require for example that your name, Facebook account and photo be displayed on Facebook. SHOULD YOU NOT AGREE THERETO, DO NOT ATTEMPT TO ENTER THE COMPETITION. Winners have the right to decline permission to use their name or image in marketing material or participate in any marketing activity. Should the winner verbally or otherwise agree to it, the Promoter may publish the winner’s name and images on, including but not limited to, the Promoter’s Facebook page or website, if applicable, without any liability to the Promoter or remuneration due to the winners.
  39. The Participant grants to the Promoter the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sub-licensable right and license to use, perform, exhibit, reproduce and/or otherwise exploit the comment and photo in any manner and in any and all distribution channels, venues or media now known or hereafter devised, without further notice or any compensation to Participant. Participant further agrees, upon the Promoter’s request and without compensation, to sign any and all necessary and appropriate documents so as to effect, perfect or record such grant of license rights

    PUBLICITY AND DATA PRIVACY
  40. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoter and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.
  41. Should the Participant have elected to receive marketing communication from the Promoter and other AVI Limited brands, the Participant’s contact details will form part of the Promoter’s database and they will receive marketing communication on, including but not limited to, upcoming promotions, competitions and offers related to AVI Limited brands. The Participant’s personal information will be shared with the AVI Limited brands and their agents to the extent necessary to ensure they receive this communication either via email or SMS, and for prizes to be delivered to prize winners for example. Should a Participant wish to remove their details from this database at any stage, please select the opt-out option made available to you or contact the Promoter’s consumer care line.
  42. All personal information relating to the Participants will be used solely in accordance with South African consumer and data protection legislation.
  43. Should the Participant have elected to receive marketing communication from the Promoter and other AVI Limited brands, the Participant’s contact details will form part of the Promoter’s database and they will receive marketing communication on, including but not limited to, upcoming promotions, competitions and offers related to AVI Limited brands. The Participant’s personal information will be shared with the AVI Limited brands and their agents to the extent necessary to ensure they receive this communication either via email or SMS, and for prizes to be delivered to prize winners for example. Should a Participant wish to remove their details from this database at any stage, please select the opt-out option made available to you or contact the Promoter’s consumer care line.
  44. Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoter in terms of the Consumer Protection Act.

    GENERAL

  45. Please note that the following terms require you to take on risk, limit the liability of the Promoter and indemnify the Promoter. Please read them carefully and contact the Promoter if you have any questions!
  46. The Promoter reserves the right to extend, reasonably shorten, suspend the time period of the Competition or terminate the Competition whenever it should so choose for technical, commercial, or operational reasons, or for reasons beyond its control or generally for any reason whatsoever within their sole discretion. The Competition, its prizes, and terms and conditions may be amended by the Promoter, at any time during the Competition, and will be applied and interpreted within their sole discretion. In such an event, all Participants waive any rights that they may have/purport to have in terms of this Competition, and acknowledge that they will have no recourse against the Promoter whatsoever.
  47. All publicity and other materials will be the sole property of the Promoter.
  48. Participants confirm by their entry into the Competition that Facebook is not the promoter of this Competition, it is in no way sponsored, endorsed or administered by or associated with Facebook and they fully release Facebook from any liability in connection with this Competition. Any questions, comments or complaints regarding the Competition are to be directed to the Promoter.
  49. The Promoter is not responsible for –
  50. entries that are lost, late, illegible/garbled, corrupted, misdirected, defective, inaccessible, compromised, incomplete, damaged or delayed and all such entries are void and will not result in Competition entry;
  51. any entry that is not delivered, received or is delayed or damaged due to technical reasons or failure on the part of your service provider. Proof of sending is not proof of receipt. Participants are responsible for their own costs of connecting to the Facebook account.
  52. To the fullest extent permitted by law, by participating, the Participant indemnifies, releases and agrees to hold harmless the Promoter, their associated, holding and subsidiary companies, and its directors, officers, agents, representatives, shareholders, employees, successors and assigns from any and all claims or liability arising from participating in the Competition, any Competition-related activity and/or acceptance, receipt, possession or use/misuse of any prize.
  53. To the extent permitted by law, the Promoter will not be liable in any way whatsoever, for any claims arising from loss, injury, damage or costs, suffered by a Participant in relation to this Competition or the prizes offered, including but not limited to claims relating to defects in the prizes or any losses caused by such defects or losses arising from incorrect or inaccurate information supplied by Participants.
  54. The Promoter will not be liable for any loss suffered as a result of incomplete or incorrect information provided.
  55. South African law shall govern these competition terms and conditions and the courts of South Africa shall have exclusive jurisdiction.
  56. By entering this Competition Participants agree to the aforementioned terms and conditions. Yardley Bambi iBonus Wholesale Promotion Terms and Conditions

  1. This Indigo Wholesaler promotion “Bamba iBonus” (“the Competition”) is organised and conducted by Indigo Brands (Pty) Ltd, a subsidiary of AVI Limited, including their affiliates, partners, associates and agents (collectively referred to hereafter as “the Promoter”).
  2. The Competition is exclusive to participating wholesale stores.
  3. The Competition will run from Monday, 03 September 2018 at 08h00 until Friday, 30 November 2018 at 18h00. Entries received after the closing date will not be considered.WHO CAN ENTER?
  4. Participants must be 18 years or older (or if a minor, must be duly assisted by their legal guardians) and have a valid identity document or passport and reside in the Republic of South Africa during the period of the Competition (“Participants”/”you”/”your”).

  7. This is a USSD based Competition. Entry will only be via USSD from the Participant’s cellular phone, all networks are supported. USSD will be charged at R0.20c per 20 seconds each. Errors will be billed. By entering this Competition it will be deemed that the cellular service account payer has agreed to the charges.

No responsibility will be accepted for any entry that is not delivered, received or is delayed or damaged due to technical reasons, including telecommunication failure on the part of the Participant’s cellular service provider, or otherwise. Enter the unique code found on the sticker and answer the one question provided.

  17. The airtime and cash winners will be chosen at random by the back-end system. This will be determined according to the competition algorithym.AWARD TERMS

  19. Cash winners – Winner who have received a cash value R500 and more will be notified instantly that they are a winner and informed that a call centre agent will contact the winner within 72 hours to verify the winner. A call centre agent will contact the winner and ask the winner to send their till slip through as proof of purchase. Once proof of purchase has been verified, instructions in the SMS to all winners will confirm that Customers will be paid via Standard Bank InstantMoney. Customers will receive two SMS’s with two different codes in order to withdraw the cash from any Standard Bank ATM. The first SMS will have a 4-digit code; and the second code will be received from Standard Bank via SMS. These codes are valid for 30 days from receiving the SMS with these codes. Customers will forfeit their prize if not redeemed at a Standard Bank ATM within 30 days of receiving the SMSes with the two different codes.
  20. Winners who receive a cash value under R500 will be notified instantly that they are a winner. Instructions in the SMS to all winners will confirm that Customers will be paid via Standard Bank InstantMoney. Customers will receive two SMS’s with two different codes in order to withdraw the cash from any Standard Bank ATM. The first SMS will have a 4-digit code; and the second code will be received from Standard Bank via SMS. These codes are valid for 30 days from receiving the SMS with these codes. Customers will forfeit their prize if not redeemed at a Standard Bank ATM within 30 days of receiving the SMSes with the two different codes.
  21. Winners don’t need to be a Standard Bank customer or have a bank account or cash card or to receive an InstantMoney voucher. To redeem their cash prize, winners need to go to any Standard Bank ATM. Select “Collect Voucher or Cardless withdrawals”. Key in the 4-digit cash collecting pin which was sent and then key in the voucher number which was SMSed to them by Standard Bank and take the money.
  22. Winners will not be given an option on how much money can be draw; the amount that was won will be given to the winner at once.
  23. Airtime winners – Please note that only pinless airtime will be send to winners who must be on prepaid to redeem for their own phone. For airtime winners, an option will be displayed to advise if the user is on contract, Virgin Mobile or Prepaid.  Pinless airtime will automatically be uploaded to the winner’s phone if the prepaid option was selected.  Pinless airtime cannot be uploaded to users on Contract or Virgin Mobile, therefore all contract and Virgin Mobile users will be presented with an option to nominate someone on Prepaid that they would like to send the airtime to. The winner will be asked to enter the 10-digit prepaid number they would like to recharge with the airtime value won.
  24. Cash and airtime winners are to keep their till slips for potential auditing purposes throughout the promotional period.PUBLICITY AND DATA PRIVACY

  27. By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoter and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.

To the extent permitted by law, the Promoter will not be liable in any way whatsoever, for any claims arising from loss, injury, damage or costs, suffered by a Participant in relation to this Competition or the prizes offered, including but not limited to claims relating to defects or poor performance of  the prize not covered by the manufacturer’s warranty or any losses caused by such defects or losses arising from incorrect or inaccurate information supplied by Participants or incorrect installation of the prize.
  35. The Promoter will not be liable for any loss suffered as a result of incomplete or incorrect information provided.
  36. South African law shall govern these competition terms and conditions and the courts of South Africa shall have exclusive jurisdiction.
